I think this debate comes down to what is more important: privacy or property. The most powerful tools to enforce property law are really invasive, but if property is valueless it becomes very difficult to make a living at creating art. There are no easy answers here.
On a specific note, giving AOL the power to turn off access to Google because someone can find their intellectual property with the search algorithm is going too far. There is a middle ground to be found here, but that is not it.
